1.1 The website is owned and run by Mana Earthly Paradise. By using the website, you accept the terms and conditions in whatever form they take at the time of use. The terms and conditions apply to all your use of the website.
1.2 Mana Earthly Paradise may add to, renew or improve the information on the website. Mana Earthly Paradise retains the right to change, add to or delete all or parts of the website at any time. If you continue to use Mana Earthly Paradise’s website after changes have been published on this page, you thereby accept the changes.
1.3 Separate terms and conditions apply to the frequent guest programme and reservations.
2. INTELLECTUAL PROPERTY RIGHTS
2.1 All content on the website is protected by copyright, trademark legislation, patents or other intellectual property rights. Unless otherwise stated, the material published on the website belongs to Mana Earthly Paradise, companies within the Mana Earthly Paradise group or their licensors
2.2 You may print out individual pages from the website. Otherwise, you may not copy, reproduce, publish, upload, send, transfer or distribute any material or any information from the website without first receiving written permission from Mana Earthly Paradise.
3.1 By using this Website to make reservations with Mana Earthly Paradise, you agree to be bound by all of such Mana Earthly Paradise’s standard terms and conditions and by any other policies, terms and conditions that may apply.
3.2 By using this website to make reservations, you hereby authorize the Mana Earthly Paradise and us to use your personal information including credit/ debit card information that you provide to us for the purpose of the reservation.
3.3 You may only make reservations through this website for yourself and your guests. If you intend to book more than two (2) rooms for the same period of stay on behalf of one or more guests, you must contact the Mana Earthly Paradise directly to make the reservation. You are prohibited from using this website for the purposes of reselling, posting, advertising or marketing reservations (whether online or otherwise) to third parties including online agents, third-party owned websites, or travel agents.
3.4 Mana Earthly Paradise reserves the right to require proper proof of identity (e.g. passports or national identity cards) from all persons checking in. Mana Earthly Paradise has the absolute discretion to refuse to check in if the identity does not match with the person mentioned in your reservation or if anyone refuses to provide the requisite proof of identity to Mana Earthly Paradise. We reserve the right to cancel or modify at our sole discretion any reservations that have been made in breach of the Terms and Conditions or for false, fraudulent or unauthorised purposes.
4. CANCELLATION POLICY
4.1 The cancellation policy of any reservation may vary depending on the room rates, occupancy levels, availability or other Mana Earthly Paradise requirements. The cancellation policy will normally be provided to you along with the confirmation of your reservation. Any cancellation of your reservation through this website must comply with the cancellation policy applicable to the reservation.
4.2 Cancellation of a booking includes but is not limited to:
Cancellation of one or more days of a booking; If the stay is shortened prior to arrival, 50% of the price of the Dome will be charged per night shortened. If you shorten your stay with us during your visit, 100% of the price of the Dome will be charged per night shortened. In case of a no-show or cancellation the Guest(s) will not be refunded for transport bookings that have already been settled
An amendment to a booking so that none of the dates of the booking once amended fall within the same dates that originally constituted the booking;
Refusal to sign the waiver of liability and credit card authorisation form, and/or failure of all guests to provide Passport/ID pursuant to DEPOSIT clause above; and
Attempt to hold an event at Mana Earthly Paradise in breach of these Terms and Conditions
20% of the total stay cost will be forfeited if the cancellation is made 31 days or more before the start of the booking period.
50% of the total stay cost will be forfeited if the cancellation is made between 8 and 30 days before the start of the booking period.
100% of the money paid will be forfeited if the cancellation is made between 1 and 7 days before the start of the booking period.
4.3 Notwithstanding the foregoing, it is our standard cancellation policy that in the event of a cancellation of your guaranteed reservation less than 24 hours prior to 6.00 pm of your scheduled arrival date (according to the local time), or in case you fail to show up without a valid reason, the Mana Earthly Paradise has the right to debit a one-night cancellation charge from the credit/ debit card provided to secure the reservation and/or saved in your account.
4.4 Notice of cancellation must be received by Mana Earthly Paradise in writing via email, to our reservation team at email@example.com.
5. Credit/debit card information
5.1 As of 1 June 2019, you must provide valid credit/ debit card information (such as card type, card number, expiry date and the full name shown on the card) to us and to the Mana Earthly Paradise to secure your reservation or to pay an advance deposit for prepaid or advance purchases. No payment will be deducted from your credit/ debit card at the time of reservation unless it is for prepayment or advance purchase.
5.2 By providing your credit/ debit card information, you represent and warrant that (i) you are legally authorized to use the credit/ debit card you provided; (ii) you authorize us to charge you in full for all charges incurred by you and your guests (if applicable) or charged to your account for all products and services purchased by you and any damage or loss caused by you and your guests during your stay (including, without limitation, damage to the Mana Earthly Paradise’s property); (iii) you authorize us to charge you in full the prepayment or advance purchase at the time of reservation; and (iv) you authorize us to charge any cancellation charges to your credit/ debit card.
5.3 While all reasonable security measures will be taken to secure your credit/ debit card information, you agree to hold us and our employees and officers harmless and release us from any actions, claims, liability, damage or loss resulting from any loss, release, compromise, or disclosure of your credit/ debit card information caused by malware attacks, phishing attacks, viruses, hacking activities, malicious software and any other unlawful interference of the website’s operating system or unauthorised access by third parties.
6.1 Where applicable, you may charge the purchase of goods and services including food and beverage, spa services or other Mana Earthly Paradise activities to your room during your stay. You are personally liable for the full payment of all such charges which may include any applicable service charges, duties, taxes, or tariffs. You are required to pay and settle all such charges fully upon receipt of Mana Earthly Paradise bill or during check-out.
6. 2 If you choose to check out of Mana Earthly Paradise without settling your bill in full, you expressly and irrevocably authorise us to charge to your credit/ debit card, which was used at the time of check-in, provided to secure your reservation, or saved in your account (whichever is available), all charges you and your guests may have incurred including any damage or loss caused by you or your guests to Mana Earthly Paradise during your stay.
You are advised not to bring expensive jewellery, precious goods or excessive amounts of cash onto the Mana Earthly Paradise premises and you do so at your own risk. While Mana Earthly Paradise provide reasonable security, Mana Earthly Paradise are not designed as high security areas for the safekeeping of expensive jewellery, precious goods or large sums of cash. Please ensure that all items of value are always stored securely and not left unattended. Safety deposit boxes and in-room lockers are available for your use. To the extent permissible by law, we will not be liable for any loss of or damage to any property brought onto the Mana Earthly Paradise premises. In the event that we are found to be liable for any such loss or damage, we shall not be liable for such loss and damage to an amount exceeding the statutory limitation available under the applicable local laws and regulations.
8. USER-GENERATED CONTENT
The term user-generated content relates to all content that visitors to the website create on or upload to the website, e.g. entries in guest books, photos or comments in a forum, and so on. When you choose such functions on the Mana Earthly Paradise website, you directly contribute content that you yourself are responsible for and that you as a user can be held accountable for. Mana Earthly Paradise has the right to remove, fully or in part, user-generated content that, wholly or partly, breaches applicable law or that in some other way can be considered damaging to Mana Earthly Paradise. In the case of such misuse, Mana Earthly Paradise is also entitled to take further measures that may be necessary to combat the abuse.
10. LIMITATION OF LIABILITY
In no event shall Mana Earthly Paradise or their respective affiliates, agents, representatives or licensors be liable to you for any loss or injury or any damages, either direct, indirect, punitive, special, incidental, consequential or otherwise (including, but not limited to, lost profits or lost savings) resulting from or in any way connected to the site or these terms and conditions, even if you have been advised of the possibility of such damaged.
11. PERSONAL DATA
Your privacy is of the utmost importance to Mana Earthly Paradise and we take our commitment to protect Personal Data seriously. Mana Earthly Paradise only processes Personal Data in accordance with applicable law and, when required, your consent is obtained. For further information about for what purposes Mana Earthly Paradise processes your Personal Data as well as your right to review, change and delete your Personal Data.
13.1 All information about your credit or debit card number, expiry date and invoicing and delivery addresses that you provide in conjunction with transactions will be used by Mana Earthly Paradise, or by others on our behalf, to process the transaction. The information will be saved on a secure server and be encrypted, and may be used by Mana Earthly Paradise to facilitate and personalise future transactions with you.
13.2 Although Mana Earthly Paradise takes all reasonable measures to protect your personal data, we cannot guarantee the security of information that you submit when you are online.
13. GOVERNING LAW
Except to the extent that another laws are applicable to you during your stay and that such application cannot be waived or altered by contract, the Term and Conditions shall be governed by and construed in accordance with the laws of Republic of Indonesia, without giving effect to conflicts of laws, rules or principles.
14. DISPUTE RESOLUTION
Any dispute, controversy, difference or claim arising out of or relating to the Terms and Conditions, including the validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved under the jurisdiction of District Court in Denpasar, Bali.
15. Amendment of the Terms and Conditions
Earth Company may amend the Terms and Conditions at any time without prior notice. Your continued use of the website after any such amendment constitutes your acceptance of the amended Terms and Conditions. If you do not agree to the Terms and Conditions or any revised version of the Terms and Conditions, please do not use the Website.
We retain our right to exercise or enforce any right contained in the Terms and Conditions. In the event that we fail to take action, it shall not be deemed as a waiver of our right or prevent us from taking subsequent action in respect of that right or of any other right.
In the event of any provision of the Terms and Conditions being found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of the Terms and Conditions. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.
The Terms and Conditions are written in the English language and may be translated into other languages. In the event of any inconsistency between the English version and the translated version of the Terms and Conditions, the English version shall prevail.
